ToolBerry Pro Terms of Service (Draft)

1. The service
ToolBerry Pro provides team features for the ToolBerry field-service app — synchronization, team workspaces, storage, audit logs, and support — operated on infrastructure we run.
2. Accounts
Your business owns its workspace and administers its member accounts. You are responsible for the accuracy of account information and for safeguarding credentials.
3. Your data
You own the data your business puts into ToolBerry Pro. We process it to provide the service and do not sell it. You may export your data at any time; on termination we delete server copies after a reasonable wind-down window, on request.
4. Acceptable use
Use the service lawfully and only for your business operations. No attempts to disrupt the service, access other businesses’ data, or resell access.
5. Fees
Fees are set per business in your order form. Pilot-partner pricing and the satisfaction guarantee are described in their own documents.
6. Availability
The app is offline-first: field work continues without connectivity, and server features sync when connected. We target high availability for the backend but the offline design is the primary resilience mechanism.
7. Liability
To the maximum extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months before the claim; neither party is liable for indirect or consequential damages.
8. Termination
You may stop using the service at any time. Either party may terminate for material breach. Your right to export your data survives termination.
